This is with:
gcc 42 r118474 *and* gcc-trunk r118474 on x86_64.
gfortran.dg/constant_substring.f fails with:
constant_substring.f:0: internal compiler error: Aborted

I checked this now into 4.2.
(I somehow thought it had already been checked in and was looking too long at
the wrong place to find this regression.)
Remains to be done for 4.1.
By the way as gfortran.dg/constant_substring.f is already part of GCC (at least
4.3 and 4.2) the extra testcase was not needed.
