As said I don't necessarily see why this should prevent tail duplicating the block, the CMP can still be forwarded into the tail duplicated condition. Again we should see sinking to do its job, creating a forwarder between the CMP and the condition block (because sinking splits critical edges). But no need to "wait" for that here.
