What you've got here is a case of people following the rules of the GPL, violating their NDA, and not having the NDA enforced against them. So long as no-one enforces the NDA, what's the problem? None if a company is going to assume that companies such as Intel won't enforce their NDA! However, most companies I know of would certainly assume that Intel *would* enforce their agreement and would severely discipline any employee that caused them to breach such an agreement.
