Sorry - you are right - the test is basically flawed.  At this point I am
tempted to say that the simplest thing would be to just remove it.  It is
not really adding anything to the testsuite.  If you want to look into
crafting a more useful replacement please do, but for now I would suggest
that we simply delete it.
