not sure if this adheres to C++ standard... 
but at least gcc doesn't report any errors after this change

    The code is legal as-is and indeed both gcc3.1.1 and
    gcc3.0.4 are able to compile it just fine.
    The 2.95.x branch is not really maintained anymore, please
    consider updating you compiler.
