 FWIW, I've got a reply from intel with regard to this problem.
 
 They agreed that the current behaviour is not standard compliant. The fact 
 that icc behaves like gcc is not coincidence. They deliberately introduced 
 this bug in icc on linux in order to be compatible with gcc.
